Terms of Use

These Terms of Use govern access to and use of the Facultas website, free resume test, member resume library, matching services, documentation, and application programming interfaces.

Please read these Terms carefully.

By accessing or using Facultas, signing in, submitting information, or using an API key, you agree to these Terms. If you use Facultas for an organization, you also represent that you may bind that organization.

01 Acceptance

Agreement to these Terms

These Terms are an agreement between you and Facultas (“Facultas,” “we,” “us,” or “our”). If you do not agree, do not access or use the services.

If you or your organization has a separate written agreement with Facultas, that agreement controls to the extent it conflicts with these Terms.

02 The service

What Facultas provides

Facultas provides matching infrastructure that helps people and platforms discover and rank job, internship, and other opportunity listings. The services may include a free resume test, an authenticated library of separate resume variants, profile-based recommendations, explanations, historical placement signals, documentation, and APIs.

Facultas is not an employer, recruiter, staffing agency, or agent of any employer or applicant. We do not make hiring decisions, submit applications on your behalf, or promise that any opportunity is available or suitable.

03 Accounts and eligibility

Use accurate information and protect access

You must be at least 18 years old, or use Facultas with the agreement and supervision of a parent or legal guardian. You may use the services only if you can legally enter into these Terms and are not barred from doing so under applicable law.

You are responsible for information submitted through your account and for keeping sign-in credentials and API keys secure. Notify us promptly if you suspect unauthorized access. Free-test limits apply per person and account; you may not create or use additional accounts to avoid them. Adding, archiving, or deleting member-library resumes does not reset the one-lifetime free-test entitlement.

04 Your content

You keep ownership of what you submit

“Your Content” means resumes, profile information, preferences, prompts, feedback, and other material you submit. You retain any ownership rights you have in Your Content.

You give Facultas a limited, non-exclusive, worldwide license to host, copy, process, transmit, and display Your Content only as reasonably needed to provide, maintain, secure, and support the services and comply with law. You represent that you have the rights and permissions needed to submit Your Content.

Resume variants in the member library remain independent records. Labels, archetypes, and default status help you organize them; they do not authorize Facultas to merge one resume into another. Archiving removes a resume from active matching, and deletion follows the storage-safety and retention practices described in the Privacy Notice.

Do not submit Social Security numbers, financial account information, health records, or other information that is not needed for matching. The free resume test and member library do not send your resume to employers or apply to jobs for you. Questions about personal information may be sent to [email protected].

05 Matching results

Recommendations are informational

Scores, rankings, explanations, eligibility indicators, placement history, and other outputs are estimates based on available information. They may be incomplete, inaccurate, or out of date and should be used as one input—not as professional, legal, immigration, career, or hiring advice.

When you select one resume, matching uses that named resume only. All-resume mode may compare saved variants, return a job once, and identify the best-fitting resume; that comparison is a ranking aid, not a merged resume or a guarantee. Account and search settings supplied for visa, citizenship, work authorization, clearance, geography, paid-only, compensation, and job types remain authoritative over resume-derived signals.

Facultas does not guarantee eligibility, application deadlines, listing accuracy, interviews, offers, placement, compensation, work authorization, sponsorship, or any other outcome. Verify material details with the original posting and employer before acting.

You may not use Facultas outputs as the sole basis for making an employment, admissions, credit, housing, insurance, or other high-impact decision about another person.

06 API use

Rules for integrations

API access is limited to the scope, rate limits, and other restrictions assigned to your credentials. You may use the API only for your own authorized integration and may not sell, sublicense, share, or expose API credentials.

You are responsible for your integration, your end-user notices and consents, and the lawfulness and accuracy of data you send to Facultas. You must present results fairly, preserve source links and material qualifications, and must not describe a score as a guarantee or final hiring determination.

We may change, deprecate, or discontinue API features. When commercially reasonable, we will provide advance notice of material breaking changes to active production partners. Separate order forms or service agreements may include additional terms, fees, support levels, and data-processing obligations.

07 Acceptable use

Use Facultas lawfully and responsibly

You may not:

  • break the law, infringe another person’s rights, or submit information you are not authorized to use;
  • bypass access controls, usage limits, or security measures, or probe or test vulnerabilities without written permission;
  • interfere with the services, introduce malware, or impose an unreasonable load on our systems;
  • scrape, harvest, bulk-download, resell, or build a substitute database from the services except through an authorized API integration;
  • reverse engineer or attempt to discover non-public source code, models, ranking weights, or underlying components, except where applicable law prohibits this restriction;
  • misrepresent Facultas results, remove source or attribution information, or imply that Facultas endorses an employer, applicant, or opportunity; or
  • use the services to discriminate unlawfully, surveil individuals, or make prohibited automated decisions.

08 Ownership

Facultas technology and materials

Facultas and its licensors own the services, including the software, design, documentation, selection and arrangement of data, ranking methods, and branding. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the services for their intended purpose.

Third-party job postings and marks belong to their respective owners. If you send suggestions or feedback, you allow us to use them without restriction or compensation, but you are not required to provide feedback.

09 Third parties

Listings, links, and sign-in providers

The services may display content from employers, job boards, applicant-tracking systems, public agencies, aggregators, and other third parties, and may link to their sites. We do not control or endorse third-party content, policies, availability, or conduct. Your dealings with third parties are between you and them and may be governed by separate terms.

Third-party services used for sign-in or other features may collect information under their own terms and privacy policies.

10 Availability and changes

The services will evolve

We may add, remove, or change features, sources, limits, or eligibility for free access. Services may be interrupted for maintenance, security, vendor outages, or other reasons. We do not promise that any feature or listing will remain available.

We may update these Terms. Material changes will be posted with a new effective date and, when appropriate, additional notice. Continued use after updated Terms take effect means you accept them.

11 Suspension and termination

When access may end

You may stop using Facultas at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay agreed fees, or if needed to protect the services or others. When practical, we will provide notice and an opportunity to address the issue.

You may archive or delete individual resumes through the member library and may request account-level deletion by contacting us. We may retain limited account, quota, request, security, backup, and legal records as described in the Privacy Notice, including records needed to preserve the one-lifetime free-test limit.

Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and general terms—will survive.

12 Disclaimers

The services are provided “as is”

To the fullest extent permitted by law, Facultas provides the services and all results “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

13 Limitation of liability

Limits on responsibility

To the fullest extent permitted by law, Facultas and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or business interruption, arising from or related to the services or these Terms.

To the fullest extent permitted by law, our total liability for all claims arising from or related to the services or these Terms will not exceed the greater of $100 or the amount you paid Facultas for the services during the 12 months before the event giving rise to the claim. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.

Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you.

14 General terms

The rest of the agreement

Business indemnity. If you use Facultas on behalf of an organization, that organization will defend and indemnify Facultas against third-party claims, damages, and reasonable costs arising from its integration, its end-user relationship, its data, or its material violation of these Terms.

Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in San Diego County, California will have exclusive jurisdiction, except that either party may seek injunctive relief in any court with jurisdiction.

Assignment. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets, or by operation of law.

Severability; waiver. If any provision is unenforceable, it will be modified only as much as needed and the remaining provisions will stay in effect. A failure to enforce a provision is not a waiver.

Entire agreement. These Terms and any additional terms expressly incorporated into them are the complete agreement about the services, unless a separate written agreement applies.
